On April 6, 2022, an online hearing for a shareholder capital contribution dispute case represented by our firm was conducted by the Putuo District People’s Court in Shanghai.
Prior to the hearing, the defendant filed a motion to suspend the proceedings. As the plaintiff’s legal representative, our lawyers submitted a response to the defendant’s motion. The representatives of both parties engaged in a written court debate focusing on the following key issues:
1.The relationship between this case and a shareholder interest damage liability dispute that was remanded for retrial by the second instance court but has not yet been accepted for filing;
2.Whether this case constitutes duplicate litigation;
3.Whether the plaintiff can file this lawsuit after the compulsory liquidation procedure was terminated due to the company’s inability to be liquidated.
