Our firm represented the majority shareholder of a company as a third-party respondent in a dispute over the request to change company registration information. After winning the case in two levels of court, the court dismissed the legal representative’s claim to remove the company’s business registration information.
Dissatisfied with the effective judgment, the company’s legal representative applied for a retrial to the Shanghai High People’s Court. On January 17, 2022, our lawyers attended the hearing as notified by the court.
During the hearing, the court revisited key facts, including whether the retrial applicant was merely a “nominal” legal representative, whether they had submitted a resignation as chairman during their term, and whether they held the company’s financial records. The parties also debated whether the cases submitted by the retrial applicant to the court were comparable to the current case.
The court will issue a ruling at a later date.
